Under NJSA 2C:12-1(b), a person can commit an aggravated assault against another in upwards of 11 different ways.  The following six, however, make up the majority of cases that are brought for prosecution at Middlesex County Superior Court.  A person is guilty of an aggravated assault if:

  3. They recklessly cause bodily injury to another through the use of a deadly weapon.
  4. They commit a simple assault against any of the following classes of persons:  policemen, firemen, EMTs, any DYFS (Division of Youth and Family Services) employee, any school employee, any person that is a judge, any bus operator, any department of corrections employee, or any person employed by a utility company.
  5. They cause bodily injury to another while attempting to flee or elude law enforcement officials.
  6. They attempt to cause significant bodily injury to another or purposely or knowingly cause such injury or under circumstances manifesting extreme indifference to the value of human life recklessly cause such injury.
